Depending on the severity, a tag may result in a fine. A facility’s appeal options depend on whether it received a fine from the tag. The letter accompanying the statement of deficiencies will identify which tags resulted in a fine and the amount of the fine. If a tag resulted in a fine, the facility may choose to either request reconsideration or a hearing. If a tag does not result in a fine, the facility’s appeal option is limited to reconsideration.
Each tag wishing to be appealed must be specifically identified in the reconsideration or hearing request. For example, if a facility received eight different “tags” on a survey, it must identify which of the eight tags it wants reconsidered. If requesting a hearing, the facility must identify which of the tags that resulted in fines it wishes to pursue a contested case hearing on. Tags included in a hearing request that did not result in a fine will not be granted the appeal request. A separate reconsideration request must be submitted for those tags.
Reconsideration requests must be submitted within 15 calendar days. Hearing requests must be submitted within 15 business days.
